Los Angeles, CA, United States (AHN) – Summit Entertainment, who clearly isn’t profiting enough from its blockbuster “Twilight” saga, is suing clothing brand BB Dakota for advertising their blue jacket as the one worn by Kristen Stewart’s Bella Swan in the movie “Twilight.” The only problem with the lawsuit: it is the blue jacket worn by Kristen Stewart’s Bella Swan in the movie “Twilight.”
The lawsuit claims copyright and trademark infringement because it’s advertised on the brand’s site as the “Jacket seen in ‘Twilight.” “Bella Swann wears this jacket in Twilight and scores the hottest vampire in high school, and so can you!” reads the item description on the Dakota Collective website, where it retails for $70.00
Summit seeks an injunction against further sales of the jacket, all profits earned from the jacket, and wants BB Dakota to deliver all remaining Bella jackets to Summit for destruction.
The jacket, which first debuted in 2008, was in stores for it became part of the “Twilight” phenomenon. In fact, the film’s costume designer Wendy Chuck bought it at a Nordstrom Rack during a last-minute run to hunt for a replacement for the brown hoodie Stewart was supposed to originally wear. It matched hair too closely.
“I was planning to use the brown hoodie for that sequence, but the director of photography hated the fact that [Stewart's] hair and the jacket were both brown and felt she got lost in it,” Chuck told Entertainment Weekly.
“I literally brought that blue one on set just before they rolled cameras,” Chuck continued. “Then Catherine said, ‘Wendy saved the day!’ That made me a hero.”
Summit, instead, looks more like the villain in this stretch by asking for the destruction of merchandise that was part of an already-existing line prior to “Twilight” being filmed. Can they stop the company from associating the jacket with the film? Probably, but it’s not false advertising. The jacket is the one worn by Stewart in the first movie. So go vamp it up girls and snap up the blue jackets before they possibly vanish.
